Sen. Harkin Floats Bill to Help Charities, Co-Ops Offer Pensions

Sen. Tom Harkin, D-Iowa, chairman of the Senate Health Education Labor & Pensions (HELP) Committee, introduced legislation Tuesday that would make it easier for charities and cooperatives to continue to offer pensions to their employees.

The bipartisan bill, the Cooperative and Small Employer Charity Pension Flexibility Act of 2013 (S. 1302), co-sponsored by Sens. Patty Murray, D-Wash.; Lisa Murkowski, R-Ark.; and Al Franken, D-Minn., would ensure that charitable and cooperative associations are not swept into the Pension Protection Act of 2006 (PPA) funding rules, “which would require them to divert funds from critical services and jeopardize their ability to provide pension benefits to their workers,” Harkin said.  

Harkin introduced the bill at a hearing titled Pooled Retirement Plans: Closing the Retirement Plan Coverage Gap for Small Businesses. He explained that many charities and co-ops provide their employees with retirement benefits through defined benefit multiple-employer pension plans (CSEC plans), which allow small, community-focused employers to pool their resources to achieve economies of scale otherwise only available to large employers.

Pooled retirement plans are also known as multi-employer plans.

Harkin noted that although CSEC plans have operated successfully for decades, they are poised to become subject to PPA, “which would threaten the ability of many nonprofit employers to continue to offer pension benefits.”

Since enactment of PPA in 2006, “it has become increasingly apparent that the PPA funding rules remain inappropriate for the unique structure of CSEC plan,” Harkin said.

When Congress passed PPA, which fundamentally changed the way most pension plans are funded in order to protect participants and the Pension Benefit Guaranty Corp., Harkin continued, “it recognized that the new rules were not necessarily appropriate for rural cooperative multiple employer defined benefit plans because, by design, the plans pose little risk that they will be unable to pay benefits.”

Consequently, Congress granted the plans a temporary exemption from PPA, which was later broadened to include eligible charities by the Pension Relief Act of 2010. “Without congressional action, the temporary exemption will expire and CSEC plans will be forced to comply with PPA funding rules,” he said. “That will result in many small, nonprofit employers being unable to continue to provide pension benefits to middle-class families.”

Harkin also noted that he plans to release likely this summer legislation that he has been working on to provide universal access to pension plans via Universal, Secure and Adaptable (USA) Retirement Funds.

Harkin said his plan is two-pronged: along with offering the USA funds, it would raise Social Security benefits by $65 per month.

But Harkin said he’s also “committed to making the system work better for employers that are already offering good pension benefits to their employees.”

The nation faces a retirement income deficit—the difference between what workers have saved for retirement and what they should have saved—which is estimated to be at least $6.6 trillion, Harkin said.

Plus, half of Americans have less than $10,000 in savings, he said. “Most people simply are not saving enough for retirement," he said, "and the dream of a secure retirement is growing more and more remote for middle-class families.”

    LOS ANGELES (MarketWatch) -- Japanese stocks opened lower Thursday, as gains for the yen and losses for Wall Street conspired to drive the Nikkei Stock Average (JP:NIK) down 1.2% to 15,333.35, extending Wednesday's 0.6% loss. It has been a roller coaster ride for homebuilders the last several years. A spectacular boom in the housing market was followed by a tragic collapse. Not only did prices plummet, but the number of new homes being built plunged to levels around half of what they were in the 1960's - back when the United States had more than 100,000,000 fewer people living in it.After some very dark days, homebuilders finally started to see some signs of life in 2012. You can see a solid rebound in the number of new housing starts recently: In May 2013, new housing starts ran at an annualized rate of around 900,000. Tuesday’s ETF Chart To Watch: EWA In Focus After Aussie ...

Best European Companies To Watch For 2015

Investors kicked off the trading week on a bearish note as profit taking pressures swept in following the markets' run-up to all-time-highs last week. The bulls got a whiff of better-than-expected data after ISM nonmanufacturing results came in above last month's reading, however, hawkish comments from Dallas Fed official Fisher stole the headlines; Fisher reiterated that markets have become too accustomed to the Fed serving as a "lifeline" and that scaling back on bond repurchases should be expected .

Our chart to watch for the day is the iShares MSCI Australia ETF which will look to resume its rebound following the latest Reserve Bank of Australia interest rate decision. Analysts are largely expecting for the RBA to cut rates to 2.50% from 2.75% currently, although the commentary after the decision itself may spark a different reaction among traders in the currency market.

Chart AnalysisConsider EWA's one-year daily performance chart below. This ETF has staged an encouraging rebound over the past month following its steep correction since  it peaked at $28.15 a share in late April of this year. EWA has snapped back higher in recent weeks as bargain shoppers have started to pile into this beat down foreign equity fund; despite the potential for a trend reversal here, it's worth noting that EWA remains in a downtrend, and as such, we advise utilizing a tight stop-loss for those eager to jump in long .

Click to EnlargeIn addition to the intermediate-term downtrend at hand, EWA is also rubbing right against its 50-day moving average (blue line), which it failed to summit last week .

OutlookIf the latest commentary from the RBA following the rate decision strikes an optimistic tone with investors, EWA should have the wind at its back; in terms of upside, this ETF must settle above stiff resistance at the $24 level. On the f! lip side, a discouraging economic outlook will likely sink Australian stocks; in terms of downside, EWA has immediate support around $23 a share followed by the $22 level. As always, investors of all experience levels are advised to use stop-loss orders and practice disciplined profit-taking techniques.

At the Open: Dow Industrials Off 130 Points as Shutdown Looms; International Paper Drops 2% on Merrill Lynch Downgrade

When little orphan Annie sang, “Tomorrow, tomorrow, I love you tomorrow, you’re only a day away,” I don’t think this is what she had in mind.

The U.S. government will shut down tomorrow, unless the House and the Senate, which continue to toss budget bills back and forth, reach a compromise. That fact has caused stocks to tumble this morning, prolonging the pain of last week’s drop. The S&P 500 has fallen 0.7% to 1,679.28 at 10:08 a.m., while the Dow Jones Industrials have dropped 0.8%, or 128 points, to 15,130.61.

Newedge USA’s Robbert van Batenburg explains the situation:

Today the fight over the Continuing Resolution to keep the Federal government funded comes down to the wire. If Congress doesn’t strike a deal today, the nonessential functions of the Federal government start shutting down at midnight.

The Senate reconvenes at 2pm today and to vote on the most recent House bill. This bill passed the House Saturday and leaves the government funded for 70 days but calls for 1-yr delay of Obamacare. Defeat of this bill is likely at which point Republicans in the House of Representatives will need to form a new bill to avert a government shutdown.

The Lindsey Group’s Peter Boockvar looked at what happened the last time the government closed:

To look at the past for some current market guidance, the two government shutdowns in 1995-1996 had almost no impact on equity markets. The first shutdown lasted from November 13th to the 19th and the S&P's were up 4 pts. After the temporary fix ended and the government shut down for a 2nd time from Friday December 15th 1995 to January 6th 1996, the market fell 1.5% on Monday December 18th but ended January 6th little changed from its close on December 15th. Of course the circumstances are much different today in many ways but markets should assume that a deal will come sooner rather than later because the negative consequences get too large the longer this all lasts, particularly with the debt ceiling.

Belus Capital Advisors Brian Sozzi notes signs of investor complacency in sector performance. He writes:

Shares of consumer staples (the old standby "defensives", although I have long thought in an economic pullback U.S. households trade down to private label) and dollar stores (exposed to an earnings growth rate acceleration amid a crumbling consumption backdrop) continue to track (aka "correlate") with the major equity indices. This is investors showing me front and center that portfolios continue to be overweight economic recovery (aka cyclicals and industrials; the latter deserves some froth removal considering two weeks of consolidation in European indices) plays rather than the defensive companies that stand to benefit from a less prosperous economic climate. In my view, the market logging losses in six of the last seven sessions is the initial realization on the part of strategists that portfolios are ill-prepared for near-term volatility…

Tomorrow indeed.

Cal-Maine Foods (CALM) has dropped 3% to $47.45 after the company reported a profit of 36 cents, below forecasts of 49 cents.

Omnova Solutions (OMN) has fallen 3.8% to $8.36 after it said it earned 19 cents a share, missing forecasts of 22 cents.

Chipotle Mexican Grill (CMG) has gained 1.6% to $425.84 after it was upgraded to Overweight from Equal Weight by Morgan Stanley, while Panera Bread (PNRA) has fallen 1.7% to $161.25 after the investment bank downgraded it to Equal Weight from Overweight.

International Paper (IP) has fallen 2.1% to $44.47 after it was downgraded to Neutral from Buy at Merrill Lynch.

Suppose we filled a jar with slips of paper with the names of biotech companies that have been around for at least 10 years and with a market cap of at $500 million or more written on them. The chances are quite good that if we pulled a random slip of paper out of that jar, the selected biotech's stock performed reasonably well over the last decade. Citigroup's Michael Corbat: Not Your Average Wall Street CEO

If you want to crack the code of a company -- to really understand what makes it tick as a business and, therefore, as an investment -- one of the things you have to get your head around is who's at the top: the person making the day-to-day and long-term decisions that will eventually make or break the company and, possibly, your portfolio.

For Citigroup  (NYSE: C  ) , that person is CEO Michael Corbat. Here's the second of two articles taking an in-depth look at this relative newcomer to the superbank's top spot: where he came from, some of the important things he's said or done, and why you could arguably buy stock in the country's third-largest bank solely because of his ascendancy to CEO.

Say what you mean
Right off the bat, Corbat did something that impressed me, or rather said something that impressed me: "I am ... humbled by the confidence the board has placed in me," Corbat said the day he became CEO. "I look forward to taking on the challenge of continuing what Vikram started." 

Corbat didn't have to use the word "humbled." Can you imagine this word coming out of the mouth of JPMorgan Chase CEO Jamie Dimon, or Goldman Sachs CEO Lloyd Blankfein? Now, I happen to like both of those guys, and think they're top notch CEOs, but each in their own way has a certain master-of-the-universe arrogance about them. Blankfein's is more subdued, and Dimon's is more brash, but it's there in both of them. I haven't seen that tendency, yet, in Corbat.

In the above statement, Corbat also demonstrated humility just by the mere mention of his predecessor, Vikram Pandit. Pandit saw Citi through the darkest days of the financial crisis, and began the process of stabilization that Corbat is still building on. By giving credit where credit was due, Corbat not only demonstrated humility, but fundamental decency -- rare qualities on Wall Street.

Mean what you say
Following up that auspicious beginning to his tenure as CEO, in March of this year, Corbat was addressing a group of 300 Citi executives at a Hilton Hotel in East Brunswick, NJ, where he told them: "You are what you measure." Upon reading this, my initial thought was, "How boring." But then it dawned on me that this was exactly the kind of thinking Citi needed at the top.

Again, you'd never hear Jamie Dimon uttering a phrase like this, but Jamie Dimon is exactly the kind of leader Citi doesn't need right now. Four years out from the financial crisis, when Pandit departed, Citi was still, to some degree, like a rudderless ocean liner. As such, Citi didn't need a swashbuckling, seat-of-the-pants captain. Citi needed a steady hand, one that was going to calmly reassert order, and give employees concrete metrics to live and work by. Boring? Maybe, but it was just what the situation required, and still does.

Corbat had the opportunity to impress me again in March of this year, this time, with his actions following the superbank's 2013 stress tests. If you recall, Citi failed its 2012 stress test, but, in 2013, it not only passed its stress test, but also outperformed lean, mean banking powerhouse Wells Fargo (NYSE: WFC  ) -- not to mention investor darling and fellow post-crisis banking basket case Bank of America. 

To make a long story short, based on its performance, Citi had every right to ask the Federal Reserve to increase its shareholder dividend following its successful 2013 stress test, but it didn't. Why? To the best of my knowledge, Corbat never commented, but my best guess is he was more concerned with conserving capital and repairing the bank's balance sheet than ingratiating himself with shareholders by way of capital return.

Foolish bottom line
Corbat is a Citi lifer, and takes great pride in his bank. He wants to see Citi's health and reputation as a great financial institution restored, even if that mean asking shareholders to be patient. That's the kind of long-term thinking any Fool can get behind.

In addition to the above, Corbat knows the bank like the back of his hand, having worked in many different areas of Citi's vast financial empire, including critical businesses like Citi Holdings, and foreign operations.

I would never tell a potential investor to only consider leadership when deciding whether or not to invest in a company, but leadership has become my top consideration. The CEO is the captain of the company ship, and can, quite literally, sail it into clear waters, or into the mouth of a hurricane, as we clearly saw happen with many banks in the run-up to the financial crisis.

Certainly, do the rest of your due diligence on Citigroup before deciding whether or not to invest; but when push comes to shove, also give Michael Corbat his due.

The Ensign Group, Inc., incorporated in 1999, is a holding company. The Company is a provider of skilled nursing and rehabilitative care services through the operation of 103 facilities, five home health and three hospice operations located in Arizona, California, Colorado, Idaho, Iowa, Nebraska, Nevada, Oregon, Texas, Utah and Washington. Its facilities provide a spectrum of skilled nursing, assisted living, home health and hospice services, including physical, occupational and speech therapies, and other rehabilitative and healthcare services, for both long-term residents and short-stay rehabilitation patients. Its walk-in clinics will offer daily access to healthcare for minor injuries and illnesses, including x-ray and lab services, all from convenient neighborhood locations with no appointments. In March 2014, the Company acquired Horizon Post-Acute and Rehabilitation Center, a 196-bed skilled nursing facility in Glendale, Arizona.

On January 1, 2011, the Company purchased one skilled nursing facility which also offers assisted living and independent living services and one independent living facility. On March 18, 2011, the Company purchased one assisted living facility in California. On May 15, 2011, the Company purchased a home health and hospice operation in Utah. On June 1, 2011, the Company purchased an assisted living facility in Nevada. On July 18, 2011, the Company acquired nine skilled nursing facilities. On August 1, 2011, the Company acquired a skilled nursing facility in Texas; the Company acquired a skilled nursing facility in Utah, and the Company acquired an independent living facility. On October 1, 2011, the Company acquired a skilled nursing facility in California. On December 1, 2011, the Company acquired a skilled nursing facility in Nevada! . On December 30, 2 011, the Company acquired an assisted living facility in Arizona. In November 2011, the Company acquired Pocatello Care and Rehabilitation Center. On November 22, 2011, the Company acquired Homecare Solutions.

The Company's facilities provide a range of skilled nursing and assisted living services, physical, occupational and speech therapies, and other rehabilitative and healthcare services, for both long-term residents and short-stay rehabilitation patients. As of December 31, 2011, it operated 102 facilities, of which it owned 77 and operated an additional 25 facilities under long-term lease arrangements, and had options to purchase five of those 25 facilities.

The Company's wholly owned subsidiaries, which include the Service Center, provides centralized accounting, payroll, human resources, information technology, legal, risk management and other centralized services to the other operating subsidiaries through contractual relationships with such subsidiaries. The Company also has a wholly owned captive insurance subsidiary (the Captive) that provides some claims-made coverage to the Company's operating subsidiaries for general and professional liability, as well as coverage for some workers' compensation insurance liabilities.

Skilled nursing facility revenue is primarily derived from Medicaid, private pay, managed care and Medicare payors. The Companys skilled nursing facilities provide Medicaid-covered services to individuals consisting of nursing care, room and board and social services. Rehabilitation therapy revenue is primarily received from private pay and Medicare for services provided at skilled nursing facilities and assisted living facilities. Assisted living facility revenue is primarily derived from private pay residents. In addition, Medicaid or other programs in some states where it operates supplement payments for board and care services provided in assisted living facilities. Hospic e revenues are primarily derived from ! Medicare.! It derives substantially all of the revenue from its home health business from Medicare and Managed Care sources. Its home health care services generally consist of providing some combination of the services of registered nurses, speech, occupational and physical therapists, medical social workers and certified home health aides.

    Ensign Group (NASDAQ: ENSG  ) has a new asset in its medicine chest. The company announced that, at the end of June, it had closed the acquisition of the Mountain View Rehabilitation and Care Center in Washington state. The center is an 82-bed skilled nursing facility located in the town of Marysville. The terms of the deal were not disclosed, although Ensign Group admitted that the purchase was effected in cash.
